Phantomic AI respects privacy rights and recognizes the importance of personal data protection.

As such, Phantomic AI is committed to processing personal data transmitted by its Clients, as well as by individuals browsing its website, in accordance with the provisions of Regulation 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the "GDPR"), Law No. 78-17 of January 6, 1978 relating to information technology, files and freedoms (hereinafter referred to as "Law No. 78-17"), as well as the provisions of this Privacy Policy.

Article 1 – Scope of this Policy

Phantomic AI collects and processes personal data transmitted to it:

• by companies using the Phantomic AI solution (hereinafter referred to as the "Client(s)") and their employees (hereinafter referred to as "Authorized Users"), within the framework of the Contract covering the Phantomic AI solution;
• by individuals browsing the website published by Phantomic AI accessible at https://phantomic.ai (hereinafter referred to as a "Visitor").

Article 2 – Processing Operations by Phantomic AI

2.1 – Legal Basis for Processing

To use the Solution, Clients have entered into a Agreement with Phantomic AI, with which Authorized Users effectively comply. These documents formalize a contractual relationship between the Client, Authorized Users, and Phantomic AI, serving as the legal basis for the collection and processing of personal data. Phantomic AI is authorized to process, on behalf of its Clients, the personal data necessary to provide access to the solution.

2.2 – Description of Processing

Processing Operations: Collection; consultation; use; reconciliation; transmission; organization.

Purpose(s) of Processing: Provision and management of the Phantomic AI solution; creation and use of your personal account; categorization of documents; identification of relevant information; commercial prospecting.

Category(ies) of Data Subjects: Clients of the Phantomic AI solution, Authorized Users, and Visitors.

Category(ies) of Personal Data Processed: Identification data, contact data, economic information, connection data.

Article 3 – Data Retention Period

3.1 – Retention period for data provided by Clients and Authorized Users

Personal data communicated by the Client and Authorized Users will be retained for the duration of the Contract between the Client and Phantomic AI.

3.2 – Retention period for data provided by Visitors

Personal data of Visitors is retained by Phantomic AI for a period of three (3) years from collection. Audience measurement statistics are not retained for more than six (6) months.

Article 4 – Commitments of Phantomic AI

In accordance with Articles 28 and 32 of the GDPR, Phantomic AI commits to:

• take and maintain all useful measures, in particular appropriate technical and organizational measures, to preserve the security and confidentiality of personal data entrusted to it;
• ensure that persons authorized to process personal data on its behalf respect confidentiality;
• act only on the documented instruction of the Client;
• not resell or transfer data that is strictly confidential.

In the context of processing personal data, Phantomic AI may use subsequent processors. The list of second-tier processors to date is as follows:

• Microsoft Azure (Hosting and Cloud)

Article 5 – Rights of Authorized Users and Visitors

Authorized Users have the following rights:

• Right of access
• Right to rectification
• Right to object
• Right to restriction of processing
• Right to portability
• Right to erasure

Authorized Users and Visitors are informed that they have the right to lodge a complaint at any time with the Commission Nationale de l'Informatique et des Libertés (CNIL).
